Letter to the High Representative about US policy denying visas to same-sex domestic partners of foreign diplomats and United Nations employees

17 October 2018

Federica Mogherini
High Representative of the European Union for Foreign Affairs and Security Policy

Concerns:      US policy denying visas to same-sex domestic partners of foreign diplomats and United Nations employees

Brussels, 16 October 2018

Honourable High Representative Federica Mogherini,

We undersigned MEPs are writing to you concerning the Trump administration’s new policy to deny visas to same-sex domestic partners of foreign diplomats and United Nations employees — unless they are married. The new policy will only approve visas to married couples — even if the couples are from countries that do not allow nor recognise same-sex marriage.

This is a clear attack from the Trump administration on the human rights of LGBTI people. Currently same-sex marriage is only legal in 26 countries in the world. Even if some diplomats would choose to marry their partners in order to be able to live together in the US, they would not be allowed to. Diplomats who are already in the US are from 1 October required to marry their same-sex partners in order to regularise their situation, putting them at risk should they want to go back to their country of origin. As for diplomats and UN staff who are about to move to the US, they would be barred from bringing their same-sex partners with them if not married in their countries of origin.

This homophobic act is not the first of its kind from the Trump administration, and cannot be tolerated. We the undersigned MEPs cannot watch while the Trump administration discriminates and attacks people for whom they love and choose to spend their lives with.

We therefore ask you, in accordance with the Guidelines To Promote and Protect the Enjoyment of All Human Rights by Lesbian, Gay, Bisexual, Transgender and Intersex (LGBTI) Persons, to address this in your relations with the US administration. Join us in this protest against the Trump administration and to stand up for LGBTI-rights in the EU and in the world.
